In my opinion, if it was in Creative Commons, they shouldn't pay you for your image because you gave it to the world. If they broke your customized license, then you could ask a lawyer to help you, but I don't think they owe you money... only public excuses.

It was in CC with the proviso that it not be used for commercial purposes. A for profit magazine is clearly a commercial enterprise. I am all for commons, and not just in creative endeavors, but I am not going to underwrite a national magazine.
